The surrender of a Director's Identification Number (DIN) holds significant importance for individuals who currently hold a DIN but have no active roles as a director in any company or designated partner in any LLP, nor do they intend to assume such positions in the foreseeable future. To initiate the DIN surrender process, the DIN holder must submit an application using Form DIR-5, accompanied by a declaration stating that they have never held a directorship in any company and that the provided DIN has not been utilized for submitting any official documents to any regulatory authority.

Before deactivating a DIN in such cases, the government undertakes a thorough examination of electronic records. Consequently, it can be inferred that if an individual has previously served as a director in a company using that particular DIN during their lifetime, they cannot simply surrender it by submitting an E-form DIR-5.

REASON FOR SURRENDER DIN

There are various valid reasons for surrendering a Director's Identification Number (DIN) by submitting an E-form DIR-5. These reasons include:

  1. Holding multiple DINs.

  2. Obtaining the DIN through illegitimate or fraudulent means.

  3. The unfortunate passing away of the individual associated with the DIN.

  4. A legal declaration by a competent court that the individual is of unsound mind.

  5. Being adjudicated as insolvent by the appropriate legal authorities.

DOCUMENTS REQUIRED FOR DIN SURRENDER 

To surrender a Director's Identification Number (DIN) in India, you typically need to submit the following documents and forms:

Form DIR-5: This is the primary form used for the surrender of DIN. It should be filled out with the necessary details and signed by the DIN holder.

Affidavit: An affidavit affirming the reasons for surrendering the DIN. This affidavit should be on non-judicial stamp paper of appropriate value and signed by the DIN holder.

Copy of PAN Card: A copy of the PAN (Permanent Account Number) card of the DIN holder.

Passport-sized Photograph: Recent passport-sized photographs of the DIN holder.

Proof of Identity and Address: Copies of identity and address proofs such as Aadhar card, passport, voter ID, or driver's license.

Self-attested Copy of Resignation Letter: If applicable, a self-attested copy of the resignation letter from any company or LLP where the DIN holder held a position as a director or designated partner.

Copy of Court Order: If the DIN holder has been declared as a person of unsound mind by a competent court, a copy of the court order declaring them as such.
